Today, Ecommerce Europe co-signs, together with a wide range of like-minded Brussels-based industry associations, a joint industry statement calling on establishing a transitional regime for the implementation of Article 24 of the Ecodesign for Sustainable Products Regulation (ESPR).
The sectors we represent are committed to making the ESPR deliver on its objectives, notably avoiding the destruction of unsold products by default. However, companies are witnessing a critical mismatch of timelines between their reporting obligations, which already entered into force in summer 2024, and the adoption of the first implementing act, due by 19 July 2025. We are therefore concerned about the legal uncertainty of this situation.
Drawing on the numerous calls made during the first meeting of the Ecodesign Forum by different stakeholders, we call for:
- A transitional regime for large companies that grants flexibility in the absence of standardised requirements
- A deferred date of application for the upcoming implementing acts to allow for companies to adjust to the new harmonised disclosure format and other requirements
- An explicit reference to this transitional regime in the text of the implementing acts (e.g., in a Recital)
- No retroactive application of the requirements set by the implementing acts.
